Editorial
Limit and excess
Creamy layer should be kept out , but the ceiling on
quota is artificial
The editorial is about a recent judgement of Patna High court that struck
down the 65 % reservation for SC , STs , and OBCs .
The Bihar government had raised the quota for reservation
after the caste survey .
The quota for OBC was increased from 12% to 18% . For EBC it
was increased from 18% to 25% , for SCs increased from 16 to 20% , for ST from
1% to 2% .
The court agreed with petitioner’s argument that adequate
representation does not mean. ‘ proportional representation ‘ . The court also saw merit in the argument that
there was no in-depth study before reservation was implemented .
The nine judge bench in Indirs Sawhney case in 1992 , had
fixed the quota limit to 50 % .
However, the ceiling was exempted in “ extraordinary
situation “.
The editorial favours quota expansion .
It was earmarked in the Indira Sawhney case.
